Regulation
For the mutual protection for itself and every plot, the following are hereby adopted as the rules and regulations of the Islamic Cemetery of Oregon (I.C.O.).
All visitors within the cemetery and all plots shall be subjected to said rule and regulations, and subject further to such other rules and regulations, amendments or alterations as shall be adopted by I.C.O. from time to time; and the reference to these rules and regulations in the right of interment certificates shall have the same force and effect as if set forth in full therein.
Rules and Regulations
- The I.C.O. is ONLY for Muslims of Ahlus Sunnah Wal Jamaah, therefore all others are not granted space in the I.C.O.
- The I.C.O. reserves the right to refuse any request for burial without providing any reasons.
- Only five months old fetus and older will be buried in the Cemetery.
- All funerals upon arrival at I.C.O. shall be under the supervision of the sexton (Person in charge of the cemetery).
- I.C.O. will not allow the body of any deceased to be buried without all that is required by law, such as :
- If the deceased is from the State of Oregon:
- Death certificate filled and signed.
- Metal tag (Disk) having the same number as in the Death Certificate.
- No remains will be accepted without a tag, or where the tag number does not match that of the death certificate.)
- If the deceased is from outside the State of Oregon:
- Death certificate filled and signed.
- Burial-transit permit.
- The sexton of the cemetery (Person in charge of the cemetery) has two duties:
First is the verification of the ID tag number on the casket. The number metal disk affixed to the coffin or accompanied the remains must match the number on the top left corner of the Death certificate.
Second once this is verified, the sexton signs the yellow and green copy of the death certificate. Then the sexton shall keep the green copy as part of the permanent records.
- ORS 432.317(6) No sexton or other person in charge of any place in which interment or other disposition of dead bodies is made shall inter or allow interment or other disposition of a dead body or fetus unless it is accompanied by authorization for final disposition.
- Once the remains have been accepted, they must be interred within 24 hours.
- I.C.O. reserves the right to refuse any ritual that has no ground in the Islamic Shariaha jurisprudence before, during, and after burial.
- I.C.O. reserves the right to refuse permission to anyone to open the coffin or to touch the body of the deceased without the consent of the legal representative of the deceased or without a court order.
- Burial in I.C.O. follows the phase sequence adopted by the county of Benton.
- Monuments shall not be permitted on graves or plots in any section within the cemetery. Only markers, size as specified by I.C.O. shall be allowed, and they must be set level with the ground at the head of each grave space. Only one marker per grave space shall be allowed.
- Grave depth shall be a minimum of five (5) feet below the surface of the ground.
- All graves shall be flush with the surface of the ground.
- No grave sites shall be located within 25 feet of the property line, within 50 feet of a channel of any drainage way identified on a survey filed as CS 7512, within an area of riparian vegetation identified on site plan, or within 100 feet of any existing domestic well on adjacent property. No graves or structures shall be located within any utility easements on the property.
- I.C.O. disclaims all responsibility for loss or damage beyond its control, and especially from damages caused by elements, act of God, common enemy, thieves, vandals, strikers, malicious mischief makers, explosions, unavoidable accidents, invasions, insurrections, riots or order of military or civil authority, whether damage be direct or collateral.
- I.C.O. reserves the right to regulate the method of decorating graves to harmonize with surroundings. No additional plants are allowed.
- Special cases may arise in which the literal enforcement of a rule may impose unnecessary hardships. I.C.O. therefore reserves the right, without notice, to make exceptions, suspensions or modifications in anyone or all of the rules and regulations when in its judgment such charges appear advisable. Such temporary exceptions, suspension or modifications shall in no way be construed as affecting the general application of these rules and regulations.
- No burials shall occur west of the channel identified as Open Space Conservation on the Corvallis Comprehensive Plan Map during the months of October through May.
- The existing drainage channel and associated riparian vegetation along the drainage way designated Open Space Conservation on the Corvallis Comprehensive Plan Map shall be preserved to the greatest extent possible except for the development of an access drive across the channel provided for by Condition.
- I.C.O. shall not be held responsible for any information given by telephone or for any mistake occurring for want of precise or proper instructions.
- I.C.O. reserves the right to enlarge, reduce, re-plat or change the boundaries of cemetery property, including the right to modify or change the location of, remove or re-grade roads, drives, walks, parkways, or any part thereof. I.C.O. reserves to itself and to those lawfully entitled thereto, a perpetual right of access over any plot for the purpose of passage to and from other plots.
- I.C.O. reserves the right to require written application by the plot user to open any burial space.
- I.C.O. may adopt new rules and regulations from time to time or it may alter, amend or repeal all or any part of these rules and regulations. At such time these rules and regulations shall be amended or replaced by the new rules and regulations.
