Task Force on Sexual Abuse of Patients Definitions |
| "Sexual
Impropriety will comprise of a lesser offence, and comprise any
verbal behaviour that is seductive or sexually-demeaning to a
patient, including, but not limited to, inappropriate procedures,
such as inappropriate disrobing or draping practices that reflect a
lack of respect for privacy, and inappropriate comments about the
patient.
The penalty range for Sexual
Impropriety would include reprimand, apology, fine, temporary
suspension of license, or combination thereof." |
| "Sexual Abuse
will comprise a more serious offence and will include
physician-patient sex, and engaging in any conduct with a patient
that is sexual, or may be reasonably interpreted as sexual,
including, but not limited to, sexual intercourse, kissing, and/or
touching breasts or genitals.
The penalty for Sexual Abuse would be
a permanent removal of license and fine. ..no exceptions." |
| The Final Report (November 25/1991, pg 34) modified these definitions somewhat, calling for "two categories of abuse: Sexual Impropriety and Sexual Violation, with conviction for sexual violation requiring a penalty of revocation for a minimum of 5 years, with stringent criteria for reinstatement to practice of medicine". |
