Task Force on Sexual Abuse of Patients Definitions
Commissioned by College of Physicians & Surgeons of Ontario

"Sexual Impropriety will comprise of a lesser offence, and comprise any verbal behaviour that is seductive or sexually-demeaning to a patient, including, but not limited to, inappropriate procedures, such as inappropriate disrobing or draping practices that reflect a lack of respect for privacy, and inappropriate comments about the patient.

The penalty range for Sexual Impropriety would include reprimand, apology, fine, temporary suspension of license, or combination thereof."

"Sexual Abuse will comprise a more serious offence and will include physician-patient sex, and engaging in any conduct with a patient that is sexual, or may be reasonably interpreted as sexual, including, but not limited to, sexual intercourse, kissing, and/or touching breasts or genitals.

The penalty for Sexual Abuse would be a permanent removal of license and fine. ..no exceptions."

The Final Report (November 25/1991, pg 34) modified these definitions somewhat, calling for "two categories of abuse: Sexual Impropriety and Sexual Violation, with conviction for sexual violation requiring a penalty of revocation for a minimum of 5 years, with stringent criteria for reinstatement to practice of medicine".
